Terms of Service

These Terms of Service ("Terms") govern your use of DARD ("the Service"), a project management application that uses AI to structure decisions, actions, risks, and dependencies. By creating an account or using the Service, you agree to these Terms.
1. Account Responsibilities
- You must provide a valid email address to create an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 16 years old to use the Service.
- One person may not maintain more than one free account.
2. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to violate any applicable laws or regulations.
- Attempt to gain unauthorized access to other users' accounts or data.
- Submit content that is malicious, harmful, or designed to exploit the AI processing pipeline (e.g., prompt injection attacks).
- Use automated tools to scrape, crawl, or otherwise extract data from the Service beyond the provided export functionality.
- Circumvent rate limits, quota restrictions, or other technical safeguards.
3. AI Processing
The Service uses artificial intelligence (provided by OpenAI) to analyze workspace content and generate structured proposals. You acknowledge that:
- AI-generated proposals are suggestions only and require your explicit approval before becoming project records.
- AI outputs may contain inaccuracies. You are responsible for reviewing and verifying all AI-generated content.
- Your content is transmitted to OpenAI for processing. OpenAI may retain this data for up to 30 days for abuse monitoring, after which it is automatically deleted. Your data is not used to train OpenAI's models.
4. Intellectual Property
- Your Content: You retain all ownership rights to the content you create, upload, or input into the Service. We claim no intellectual property rights over your content.
- Our Service: The Service, including its design, code, and branding, is owned by DARD and protected by applicable intellectual property laws.
- License: You grant us a limited license to host, process, and transmit your content solely to operate and improve the Service.
5. Subscription & Billing
- Free accounts are subject to usage quotas as described on the pricing page.
- Paid subscriptions are billed monthly via Stripe. Prices are displayed exclusive of VAT.
- You may cancel your subscription at any time through the account settings. Access continues until the end of the current billing period.
- Refunds are handled on a case-by-case basis.
6. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or complete.
7. Limitation of Liability
To the maximum extent permitted by law, DARD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
8. Termination
- You may delete your account at any time through the settings page. This permanently removes all your data.
- We may suspend or terminate your account if you violate these Terms, with notice where practicable.
- Upon termination, your right to access the Service ceases immediately. You may export your data before deleting your account.
9. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top indicates when the Terms were last revised. Material changes will be communicated via the email associated with your account. Continued use after changes constitutes acceptance.
10. Governing Law
These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal remedies.
